General Terms and Conditions (GTC)

§1 Scope and Contracting Parties

These General Terms and Conditions (GTC) apply to all contracts for the sale and delivery of the patented analog stick retrofit accessory offered by Eleftherios Vavlas, sole proprietorship, to consumers as defined in § 13 BGB (German Civil Code). Sales are made exclusively to private individuals (B2C). Deviating customer terms shall not apply.

§2 Subject Matter of the Contract

The analog stick replaces the original stick and uses an innovative magnetic system to generate variable resistance. Compatible with PS4 and PS5 controllers. An Xbox version is in development. Installation is carried out by the buyer at their own responsibility. This is not a product of the console manufacturer. Statutory warranty rights apply when used properly.

§3 Conclusion of Contract

The contract is concluded exclusively via the website www.aimgnatic.com.

Product presentations do not constitute binding offers. By completing the order process, the customer submits a binding offer. The contract is concluded upon confirmation of the order by email.

§4 Prices and Payment Terms

All prices are final prices including statutory VAT. Note: The seller currently applies the small business regulation under § 19 UStG, therefore no VAT is shown. Payment is made exclusively via PayPal and is due immediately. In case of payment default, statutory default interest and reminder fees apply.

§5 Delivery and Shipping

Shipping is carried out exclusively to EU countries via DHL. Unless otherwise agreed, delivery times are typically 2–5 business days within Germany and 3–7 business days within the EU. The seller is not liable for shipping delays. Orders from unsupported countries will be canceled and refunded.

§6 Right of Withdrawal

Consumers have a statutory right of withdrawal in accordance with § 355 BGB. The corresponding withdrawal policy is provided separately and can be accessed at: www.aimgnatic.com/revocation

In the event of withdrawal, the buyer bears the direct costs of returning the goods.

§7 Retention of Title

Goods remain the property of the seller until full payment has been received.

§8 Warranty

Statutory warranty rights (§§ 433 ff. BGB) apply. The warranty period is two years from receipt of goods. Damage caused by improper installation or use is excluded.

§9 Liability

The seller is fully liable for intent, gross negligence, and personal injury. In cases of slight negligence, liability is limited to breaches of essential contractual obligations (cardinal duties) and to foreseeable damages. Further liability is excluded.

§10 Confidentiality and Copyright

All content, texts, images, and videos are protected by copyright. Confidential information must not be disclosed to third parties.

§11 Data Protection

Personal data is processed exclusively for contract fulfillment. The privacy policy applies and can be found at: www.aimgnatic.com/data protection

Tracking and analytics tools as well as third-party providers (e.g. Wix, PayPal) are regulated therein.

§12 Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Eppingen, unless a general place of jurisdiction exists in Germany.
